STILL on firmware 4.0, I will update it before I ship it, UNLESS you tell me NOT to.  (Some people like the older firmwares because they remain more stable, and easier to jailbreak if you want)

There is some scratches on the back from keys scratching up against it or something.  The top glass is NEARLY perfect, but some hairline scratches are present and a few up towards the upper side.  When you are using it NO scratches are visible, but see pictures so you know what you getting!
